The short version. This website tells you about Confidely and lets you ask for an invitation. Joining the waitlist is free and doesn’t guarantee an invitation. Confidely isn’t therapy, medical care or a crisis service. Use the site fairly, and don’t sign up anyone but yourself. If you live in the EU, the UK, Australia or anywhere else with consumer protection laws, nothing here takes away the rights those laws give you.

Agreeing to these terms

These Terms of Use are an agreement between you and Sphaera Nova Technologies, Inc. (“Confidely”, “we”, “us”), a Delaware corporation, at 2810 North Church Street, Wilmington, DE 19802, United States. They apply when you use getconfidely.com (the “site”) or join the Confidely waitlist.

By using the site, or by ticking the box when you join the waitlist, you agree to these terms. Please also read our Privacy Policy, which explains how we handle your information. If you don’t agree, please don’t use the site or join the waitlist.

Who can use the site

Confidely is only for adults. You must be 18 or older to join the waitlist. By joining, you confirm that you are.

Where Confidely is offered

We’re launching Confidely in Southeast Asia. The site can be reached from anywhere, but we don’t currently offer or market Confidely in other regions, including the European Union, the United Kingdom and the United States. If you use the site from somewhere else, you do so on your own initiative, and you’re responsible for following the laws that apply where you are. We may decline or remove waitlist sign-ups from places we don’t serve yet, and an invitation may not be available where you live.

What Confidely is, and isn’t

Confidely is an app, coming soon to iPhone, where you can talk things through with Anya, an AI companion.

Confidely isn’t a medical or mental health service. Anya is an AI, not a therapist, counsellor, doctor or other professional. Nothing on this site is medical, psychological or other professional advice, and nothing here diagnoses or treats any condition. Don’t use the site or the app instead of care from a qualified professional.

Confidely isn’t a crisis service. If you’re in danger or thinking about harming yourself, contact your local emergency number or a crisis line now. In the Philippines, call the National Center for Mental Health crisis line on 1553. In the United States and Canada, call or text 988. In the UK, call Samaritans on 116 123. In Australia, call Lifeline on 13 11 14. Elsewhere, find a line at findahelpline.com. You don’t have to go through it alone.

What we say about the app on this site describes our plans. Features, availability, platforms, timing and prices may change before or after launch.

The waitlist

  • Joining is free and doesn’t create any obligation for you to buy anything.
  • An invitation isn’t guaranteed. We open Confidely gradually, starting with a small founding circle. We decide who to invite and when, mostly by sign-up order and how many people we can welcome at a time. We may pause or close the waitlist at any time.
  • One person, one place. Join only with your own email address and your own name. Don’t sign up anyone else, use a fake or disposable identity, or join more than once to move up.
  • Invitations are personal unless we say they can be shared. We may cancel an invitation that’s been sold, traded or misused.
  • The app has its own terms. To use the Confidely app you’ll need to accept its own terms and privacy policy, and the terms of the App Store you download it from. These Terms of Use don’t give you the right to use the app.
  • Emails. By joining, you agree that we may email you about your place on the waitlist, your invitation and Confidely’s launch. You can unsubscribe at any time.
  • Leaving is easy: ask us at [email protected] to delete your place. To stop our emails only, use the unsubscribe link in any email.

Sharing Confidely

You’re welcome to share links to the site, including your invitation link. Please share them only with people you know or in places where sharing is welcome, never as unsolicited bulk messages, and never in a way that suggests you speak for Confidely. We don’t currently offer rewards for invitations; if we ever do, separate rules will apply.

Using the site fairly

When you use the site, you agree not to:

  • break any law, or help anyone else to;
  • use bots, scripts, scrapers or other automated means to access the site, join the waitlist, or collect information from it;
  • interfere with the site or its security, overload it, or try to get around our limits or protections;
  • probe, scan or test the site for weaknesses without our written permission (if you’ve found a security problem, please tell us at [email protected] and give us a reasonable chance to fix it before telling anyone else);
  • copy, frame, or reverse engineer the site, except as the law allows;
  • pretend to be someone else, or misrepresent your connection with anyone;
  • upload or send anything harmful, unlawful, or that infringes someone else’s rights.

Our content and brand

The site and everything on it, including the Confidely name, the Spark mark, Anya, our words, designs, images, films and software, belong to us or to the people who license them to us, and are protected by intellectual property laws.

You may view the site and share links to it for your own personal, non-commercial use. You may not use our name, logos or content in any other way without our written permission.

Your ideas. If you send us feedback or suggestions, you’re free to share them anywhere, and you agree that we may use them without paying you or owing you anything. We won’t publish your name or your words in our marketing without your separate, written consent.

Other websites

The site may link to websites and services we don’t run, such as crisis lines, app stores or data protection authorities. We link to them to help you, but we don’t control them and aren’t responsible for their content or how they handle your information.

No guarantees

We work hard to keep the site accurate, available and secure, but we provide it as is and as available. To the extent the law allows, we don’t promise that the site will always be available, uninterrupted, error-free or free of harmful components, or that information on it is complete or current, and we exclude all other warranties, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Limits on our liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that can’t be limited or excluded by law.

Otherwise, and to the extent the law allows:

  • we aren’t liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of profit, revenue, data, goodwill or opportunity, arising from the site or the waitlist, even if it was foreseeable;
  • we aren’t liable for any decision you make, or anything you do or don’t do, based on content on the site;
  • we aren’t liable for not inviting you, for the timing of an invitation, or for changes to our plans for the app; and
  • our total liability to you for all claims relating to the site and the waitlist is limited to USD 100 (or the equivalent in your currency).

The site is free, and these limits reflect that.

Your responsibility to us

If you break these terms or the law while using the site, and that causes us a loss or a claim by someone else, you agree to cover our reasonable losses and costs (including reasonable legal fees). If you use the site as a consumer, this applies only to the extent the law where you live allows it.

Suspending or ending access

We may suspend or end your access to the site, or remove you from the waitlist, if you break these terms, if we need to for legal or security reasons, or if we close the waitlist. Where it’s reasonable, we’ll tell you why. You can stop using the site and leave the waitlist at any time.

The sections on our content, no guarantees, limits on liability, your responsibility to us, and disputes continue to apply after your access ends.

Changes to these terms

We may update these terms, for example when we launch the app or change the waitlist. The version and effective date are at the top. If a change is significant, we’ll tell you by email (if you’re on the waitlist) or on the site before it takes effect. If you keep using the site after that, the new terms apply. If you don’t agree, you can leave the waitlist at any time.

Disputes and the law that applies

If you have a concern, please tell us first at [email protected]. Most problems can be solved quickly, and we’ll try in good faith to resolve yours within 30 days.

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules, and the state and federal courts located in New Castle County, Delaware have exclusive jurisdiction over any dispute about them.

If you’re a consumer, wherever you live, you also keep the protection of the mandatory laws of the place where you live and, where those laws give you that right, can bring a claim in your local courts. In particular:

  • EU and UK: nothing in these terms affects your statutory rights as a consumer. Your national consumer authority can tell you more about them.
  • Australia: our services come with guarantees that can’t be excluded under the Australian Consumer Law, and nothing in these terms excludes, restricts or changes them.
  • The Philippines, Canada, New Zealand and US states: nothing in these terms limits rights you have under consumer protection laws that can’t be waived by agreement, such as the Consumer Act of the Philippines.

General

  • The whole agreement. These terms are the whole agreement between you and us about the site and the waitlist. Our Privacy Policy explains how we handle your information.
  • If part doesn’t work. If a court decides any part of these terms can’t be enforced, the rest still applies, and the part in question applies to the greatest extent the law allows.
  • Not enforcing isn’t waiving. If we don’t enforce a term straight away, we can still enforce it later.
  • Transfers. You can’t transfer your rights under these terms. We may transfer ours, for example if our business changes hands, as long as your rights aren’t reduced.
  • Things outside our control. We aren’t responsible for delays or failures caused by events beyond our reasonable control.
  • No one else. Only you and we have rights under these terms.
  • Language. These terms are written in English. If we translate them, the English version applies if there’s any difference, unless the law where you live says otherwise.
  • Notices. We’ll send notices to the email address on the waitlist. You can send notices to [email protected].

A place to be heard.

Coming soon to iOS.

Anya is an AI companion, not a therapist.

Confidely is a space to talk things through. It doesn’t diagnose or treat anything, and it isn’t a stand-in for care from a doctor or mental health professional.

If you’re struggling or thinking about harming yourself, please reach out to your local emergency number or a crisis line in your country. You don’t have to go through it alone.
